These Terms of Service govern your access to and use of the ATHERYN website and all purchases made through our online store.

By accessing the website or placing an order, you agree to these Terms. Mandatory consumer rights remain unaffected.

1. Eligibility

You may use the website and place an order only if you have the legal capacity to enter into a binding contract.

If you are under the legal age required in your country, you may use the website only with the permission and supervision of a parent or legal guardian.

2. Use of the Website

You agree not to:

  • Use the website for unlawful or fraudulent purposes;
  • Provide false personal, delivery or payment information;
  • Attempt to gain unauthorised access to the website or customer accounts;
  • Interfere with the security or operation of the website;
  • Upload malicious code;
  • Copy or commercially exploit website content without permission;
  • Abuse promotions, refunds, chargebacks or customer-service procedures;
  • Infringe intellectual-property or privacy rights.

ATHERYN may restrict access, cancel an order or take reasonable protective action where fraud, unlawful activity or a material breach of these Terms is suspected.

3. Product Information

ATHERYN aims to display and describe products accurately.

However:

  • Colours may appear differently depending on the device or screen;
  • Measurements may vary slightly;
  • Packaging may change;
  • Minor production variations may occur;
  • Product availability may change without notice.

Nothing in this section permits ATHERYN to supply a product that materially differs from its description or does not conform to the sales contract.

4. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not reserve it.

If a product becomes unavailable after an order is placed, ATHERYN may:

  • Offer an alternative product with your agreement;
  • Cancel the unavailable product;
  • Issue a refund for the cancelled amount.

5. Prices and Currency

Unless otherwise stated, prices are displayed in euros, identified as EUR (€).

Shipping charges, taxes, duties or other mandatory fees will be disclosed before the order is completed where required by law.

ATHERYN may correct an obvious pricing or technical error before accepting or dispatching an order.

If a pricing error affects your order, ATHERYN may contact you and allow you to:

  • Confirm the order at the correct price; or
  • Cancel the affected product for a refund.

6. Promotions and Discounts

Promotions may be subject to:

  • Start and end dates;
  • Minimum order values;
  • Product exclusions;
  • Geographic restrictions;
  • Usage limits;
  • Customer eligibility requirements.

Unless expressly stated, promotional codes cannot be combined.

Promotional conditions do not remove mandatory consumer rights.

7. Orders and Contract Formation

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges receipt of your order but does not necessarily mean the order has been accepted.

A sales contract is generally formed when ATHERYN:

  • Sends an express order acceptance;
  • Dispatches the products; or
  • Otherwise clearly confirms acceptance.

ATHERYN may reject or cancel an order before acceptance for legitimate reasons, including:

  • Product unavailability;
  • Payment failure;
  • Suspected fraud;
  • An obvious pricing error;
  • Delivery restrictions;
  • Breach of these Terms;
  • Legal or regulatory restrictions.

If payment has already been collected for a cancelled order, the affected amount will be refunded.

8. Payments

Available payment methods are shown during checkout.

By submitting payment information, you confirm that:

  • The information is accurate;
  • You are authorised to use the selected payment method;
  • The payment provider may process the transaction;
  • Reasonable fraud and security checks may be performed.

9. Shipping and Delivery

Shipping destinations, charges and delivery estimates are displayed during checkout or described in the ATHERYN Shipping Policy.

Delivery estimates are not guaranteed unless ATHERYN expressly agrees to a guaranteed delivery date.

Where European consumer law applies and no different delivery period has been agreed, delivery will be arranged without undue delay and generally no later than 30 calendar days after the sales contract is concluded.

10. Delivery Address

You are responsible for providing a complete and accurate delivery address.

ATHERYN is not responsible for delays caused by incorrect or incomplete information provided by the customer.

Contact ATHERYN immediately if you notice an address error. Address changes cannot be guaranteed after processing has started.

11. Risk of Loss

For consumer purchases, responsibility for the product generally remains with ATHERYN until the customer, or a person designated by the customer, takes physical possession of the product.

12. Returns and Refunds

Returns, withdrawals, cancellations and refunds are governed by the ATHERYN Returns and Refunds Policy.

European consumers may have a statutory 14-day right of withdrawal in addition to ATHERYN’s voluntary return period.

13. Legal Guarantee

ATHERYN is responsible for providing products that conform to the sales contract.

Depending on applicable law, customers may be entitled to a repair, replacement, price reduction or refund when a product is:

  • Defective;
  • Damaged before delivery;
  • Not as described;
  • Not fit for its normal purpose;
  • Otherwise non-conforming.

European consumers generally receive a minimum two-year legal guarantee of conformity.

14. Intellectual Property

The ATHERYN website and its original content are protected by intellectual-property laws.

This may include:

  • ATHERYN branding;
  • Logos;
  • Text;
  • Graphics;
  • Photography;
  • Website design;
  • Product presentation;
  • Software and page layouts.

You may use the website only for personal, non-commercial shopping purposes.

You may not reproduce, modify, distribute, publish or commercially exploit protected content without prior authorisation.

15. Customer Reviews and Content

If you submit a review, photograph, comment or other content, you confirm that:

  • You have the right to submit it;
  • It is accurate to the best of your knowledge;
  • It does not violate third-party rights;
  • It is not unlawful, abusive or misleading;
  • It does not contain malicious code.

You grant ATHERYN a non-exclusive, worldwide and royalty-free licence to use and display the submitted content for operating and promoting the store, subject to applicable privacy laws.

16. Third-Party Services

The website may use third-party services, including Shopify, payment providers, carriers, analytics services and social media platforms.

Independent third parties may have their own terms and privacy policies.

17. Website Availability

ATHERYN may update, maintain, suspend or modify the website.

ATHERYN does not guarantee that the website will always be available, uninterrupted or free from technical errors.

This does not affect obligations relating to accepted orders.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

This includes liability for:

  • Fraud or fraudulent misrepresentation;
  • Death or personal injury caused by negligence;
  • Intentional misconduct;
  • Mandatory product-safety obligations;
  • Mandatory consumer remedies.

To the maximum extent permitted by law, ATHERYN is not responsible for indirect or unforeseeable losses that are not a natural result of a breach.

19. Events Outside Reasonable Control

ATHERYN is not responsible for delays caused by events outside its reasonable control, including:

  • Severe weather;
  • Natural disasters;
  • War or civil unrest;
  • Government restrictions;
  • Customs disruption;
  • Carrier interruption;
  • Labour disputes;
  • Widespread infrastructure or network failures.

ATHERYN will take reasonable steps to reduce the effect of the event and communicate material delays.

20. Governing Law

These Terms are governed by the laws applicable to ATHERYN’s commercial operations.

Consumers remain entitled to the protection of mandatory consumer laws applicable in their country of habitual residence.

Nothing in these Terms requires a consumer to waive a mandatory legal right.

21. Disputes

Customers should first contact ATHERYN so that we can attempt to resolve the issue directly.

Consumers may also have access to local consumer authorities, alternative dispute-resolution services or competent courts under applicable law.

22. Changes to These Terms

ATHERYN may update these Terms for future use of the website.

Changes will not retroactively remove rights connected with an already accepted order unless required by law or agreed by the customer.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
